Digital Millennium Copyright Act (DMCA) — Notice and Takedown Policy

Seacrets respects intellectual property rights and complies with the provisions of the Digital Millennium Copyright Act (17 U.S.C. § 512).

The platform operates as an online service provider that hosts user-generated content and, accordingly, relies on the "safe harbor" provisions of applicable law, provided the corresponding legal requirements are met.

1. Designated Agent

Seacrets has designated an agent to receive notices of alleged copyright infringement. Notices must be submitted through the official channel indicated in the legal contact section of the website.

Email: [email protected]

2. Notice Requirements

For a notice to be valid under the DMCA, it must include:

  • Clear identification of the copyrighted work claimed to have been infringed.
  • Precise identification of the allegedly infringing material and its specific location (direct URL).
  • Contact information for the claimant.
  • A good-faith statement that the use is not authorized.
  • A statement, under penalty of perjury, that the information is accurate and that the claimant is authorized to act on behalf of the rights holder.
  • Physical or electronic signature of the rights holder or authorized representative.

Incomplete notices may not be processed.

3. Takedown Procedure

Once a valid notice is received:

  • The content may be removed or disabled without prior notice.
  • The affected user may be notified when applicable.
  • Records will be retained in accordance with legal obligations.

Seacrets acts expeditiously to maintain safe harbor protection under applicable law.

4. Counter-Notification

A user whose content has been removed may submit a counter-notification in accordance with the requirements of 17 U.S.C. §512(g), including:

  • Identification of the removed material.
  • A statement, under penalty of perjury, that the removal resulted from error or misidentification.
  • Consent to the jurisdiction of the competent federal court in the United States.
  • Electronic or physical signature.

Seacrets may restore the content within the legal timeframes, unless the claimant initiates legal action.

5. Repeat Infringer Policy

Seacrets maintains and enforces a policy of terminating the accounts of repeat infringers in accordance with the DMCA.

The platform may suspend or cancel accounts associated with multiple valid claims or repeated patterns of infringement.

6. Statement on the Nature of the Service

Seacrets operates as a technology platform that allows users to publish content autonomously. While the platform implements automated mechanisms and human review to detect and mitigate prohibited or unlawful content, it does not perform individual, prior editorial approval of each piece of content before publication.

Primary responsibility for published content lies with the user who generates and uploads it to the platform, without prejudice to the oversight, moderation, removal, and compliance powers that Seacrets exercises under its regulatory and contractual framework.
